The terms of this Privacy Policy (as defined hereinafter) are an electronic record in terms of the Indian Contract Act, 1872, the Information Technology Act, 2000, the rules made thereunder, as may be amended, supplemented or re-enacted from time to time. This electronic record is generated by a computer system and does not require any physical or digital signatures.

Cedreto Marketing Private Limited, a company incorporated under the Companies Act, 2013, having its registered office at M-17, Gyan Deep Sagar Vihar Colony, Vaishali Nagar, Ajmer Rajasthan – 305001, India (“DYT” or “we” or “Company”  or “us” or “our”) owns, manages and operates Do Your Thng Studio (“DYT Studio”) through its website available at https://studio.doyourthng.com/ and mobile application (collectively referred to as “DYT Studio Platform”) to facilitate a platform to its users for conducting workshops (“Workshop”) which includes (i) the host of such Workshop (“Host”) and (ii) the attendee of such Workshop (“Attendee”) (collectively referred to as “User” or “Users” or “you” or “your”).

We are committed to protecting and respecting your privacy by maintaining the confidentiality of your Information (as defined hereinafter). We value and appreciate your trust in us. This privacy policy (“Privacy Policy”) describes the basis on which your Information will be collected from you on the DYT Studio Platform or that you provide to us, will be used and processed by us. This Privacy Policy applies to current and former visitors/Users of DYT Studio Platform. 

THIS PRIVACY POLICY HAS BEEN DRAFTED AND PUBLISHED IN ACCORDANCE WITH THE INFORMATION TECHNOLOGY ACT 2000; THE INFORMATION TECHNOLOGY (AMENDMENT) ACT 2008; AND THE INFORMATION TECHNOLOGY (REASONABLE SECURITY PRACTICES AND PROCEDURES AND SENSITIVE PERSONAL DATA OR INFORMATION) RULES 2011. THIS PRIVACY POLICY CONSTITUTES A LEGAL AGREEMENT BETWEEN YOU, AS A USER OF THE DYT STUDIO PLATFORM AND US, AS THE OWNER OF THE DYT STUDIO PLATFORM. YOU MUST BE A NATURAL PERSON WHO IS AT LEAST 18 YEARS OF AGE.

I. INTRODUCTION

The purpose of this Privacy Policy is to ensure that there is an intact charter to collect, use and protect any personal and/or sensitive data collected by us. This Privacy Policy defines our procedure for collection, usage, processing, disclosure and protection of any Information obtained by us through the DYT Studio Platform.

Any reference made to Privacy Policy in this document shall mean and refer to the latest version of the Privacy Policy

As a User of DYT Studio Platform, you understand and agree that we may collect, use, and disclose your Information in accordance with this Privacy Policy. This Privacy Policy describes what Information we collect about you, how we collect it, how we use it, with whom we may share it, and what choices you have regarding our use of your Information. We also describe the measures we take to protect the security of your Information data and how to contact us.

By visiting and/or using DYT Studio Platforms, you are hereby deemed to have read and understood all the terms and conditions concerning the purpose of usage and conditions of disclosure of your Information including personal and sensitive personal data and information (as is understood under applicable Indian laws) and explicitly consent to our use of such information in accordance with the terms prescribed herein. In case you decide to rescind your consent for our use of your Information including sensitive personal data and information, you will need to inform us in writing at legal@dyt.onl and your usage of the DYT Studio Platform may be terminated in such circumstances.

Please note that the only information requested from you is mentioned below in this Privacy Policy and to provide you with better and enhanced services customized to your needs.

Please be advised that any Information (as defined hereinbelow) procured by us, shall be:

  1. processed fairly and lawfully for rendering the Services (as defined in Terms and Conditions);
  2. obtained only for specified and lawful purposes, and not be used in any manner which is against the law or policy in force in India;
  3. adequate, relevant and not excessive in relation to the purpose for which it is required;
  4. able to be reviewed by the User, from time to time and updated-if need arises; and
  5. not kept longer than for the time which it is required or the purpose for which it is required or as required by the applicable law.

WE SHALL NOT BE LIABLE FOR ANY LOSS OR DAMAGE SUSTAINED BY REASON OF ANY DISCLOSURE (INADVERTENT OR OTHERWISE) OF ANY DATA, IF THE SAME IS EITHER (A) REQUIRED FOR SHARING YOUR INFORMATION FOR LEGITIMATE PURPOSES; OR (B) WAS AFFECTED THROUGH NO FAULT, ACT, OR OMISSION OF THE COMPANY.

BY USING THE SERVICES AND/OR DYT STUDIO PLATFORM, YOU EXPLICITLY ACCEPT, WITHOUT LIMITATION OR QUALIFICATION, THE COLLECTION, USE AND TRANSFER OF THE DATA IN THE MANNER DESCRIBED HEREIN.

PLEASE READ THIS PRIVACY POLICY CAREFULLY AS IT AFFECTS YOUR RIGHTS AND LIABILITIES UNDER LAW.

III. GENERAL

APPLICABILITY: This Privacy Policy applies to all services offered by us on DYT Studio Platforms including the Workshops (hereinafter referred to as “Services”) to you, except where otherwise provided.

PURPOSE OF DYT STUDIO PLATFORM: The DYT Studio Platform is intended to give a platform to the Host to conduct Workshop and to the Attendee to attend such Workshop on DYT Studio Platform. The Workshop are transmitted through our DYT Studio Platform and then is open to the Users/Attendees to attend by booking a slot at the DYT Studio Platform in accordance with our Terms and Conditions as available at https://doyourthng.com/dyt-studio-terms-and-condition/

INFORMATION OR DATA COLLECTION: Information (as defined hereinafter) is collected directly from you when you voluntarily provide us your consent to use your information and when you access various parts of our Services and/or DYT Studio Platform.

PROCESSING OF INFORMATION: Procession means any operation or set of operations which is performed on Information, whether or not by automated means, such as collection, recording, possessing, structuring, storage, dealing, handling, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

IV. INFORMATION WE MAY COLLECT FROM YOU

Personal Data” means and includes any information that relates to a natural person through which an individual is identified, such as the name, contact details, email address, gender, age, organization name, organization email id or any other relevant material provided by a User, including but not limited to information gathered through availing Services.

Technical Information” means and includes any information gathered through various technologies that may employ cookies, web beacons, or similar technologies to automatically record certain information from your device through which you use the Platform. This technical information may include your Internet Protocol (IP) address, device or browser type, Internet service provider (ISP), referring or exit pages, clickstream data, operating system, hardware model, operating system version, unique device identifiers, and mobile network. This data includes usage information and user statistics.

Locational Information” shall mean and include the information obtained through GPS or other means, such as the geographical location of the User.

Device information” shall mean any information about your device such as time zone, device type, network, operating system, carrier user id, and browser type and other information that alone or in combination may be used to uniquely identify your device or computer for system administration and to report aggregate information to our advertisers. This is statistical data about our users’ browsing actions and patterns and does not identify any individual.

“Non-Personal Information”

  1. “Information through use of our Service” means and includes information which is shared with us to avail our Services.
  2. “Non-Personal Information” means and includes any information that does not reveal your specific identity, such as, browser information, information collected through Cookies (as defined below), pixel tags and other technologies, demographic information, etc. As is true with most websites, our Company gathers some information automatically when you visit the DYT Studio Platform. When you use the DYT Studio Platform, we may collect certain information about your computer or mobile to facilitate, evaluate and verify your use of the DYT Studio Platform. For example, we may store environmental variables, such as browser type, operating system, speed of the central processing unit (CPU), referring or exit web pages, click patterns and the internet protocol (IP) address of your computer. This information is generally collected in aggregate form, without identifying any user individually.

Registration and User-Provided Information: 

  1. When you register to use DYT Studio Platforms, we may collect information about you. We may link this Information with other information about you. You may also provide us with information about you in various ways when you use our DYT Studio Platforms or send us customer service-related requests.
  2. If you contact us, we may keep a record of that correspondence.
  3. Details of your visits to our DYT Studio Platform including, but not limited to, traffic data, location data, weblogs and other communication data, whether this is required for our own billing purposes or otherwise and the resources that you access.

If you are a Host, in addition to the above, we may also collect the following data:

  1. Account Details: These include your username and password and preferred account settings such as the language and time zone etc.
  2. Information regarding your Workshop, Workshop Price quotation, prior work experience that is provided by you upon creation of your user account (as defined in Terms and Conditions) during registration on the DYT Studio Platform.
  3. Invoicing Information: In order to make payments for the Workshop provided and/or services rendered by you via the DYT Studio Platform, we would require you banking details, such as name, address, email id, PAN card details and financial information that corresponds to your bank. including but not limited to, bank name, branch, account number, IFSC code etc.

If you are an Attendee, in addition to the above we may also collect the following data:

  1. Account Details: These include your username and password and preferred account settings such as the language and time zone etc.
  2. Billing Details: shall mean and include billing details such as name, address, email id and other financial information that corresponds to your mode of payment including but not limited to, credit card/ debit card details, net banking information, bank details etc. Please note that confidential information such as the CVV/ PIN Number and the net banking credentials will not be stored by us.

(The Personal Data, Technical Information, Locational Information, Non-Personal Information and additional information collected from the Host and the Attendee respectively are collectively referred to as “Information”).

V. YOUR CONSENT 

Please note that by providing the Information, you provide your consent and authorize us to collect, use or disclose such Information for the business and other purposes and as stated in this Privacy Policy, in the Terms and Conditions, and as permitted or required by applicable law. Moreover, you understand and hereby consent that this Information may be transferred to any third party user for the purpose of providing Services through the DYT Studio Platform or to any third-party providers for rendering Services (as defined in the Terms and Conditions), any jointly developed or marketed services, payment processing, order fulfillment, customer services, data analysis, information technology services and such other services which enable us to provide Services through the DYT Studio Platform.

This Privacy Policy shall be enforceable against you in the same manner as any other written agreement. By visiting or accessing the DYT Studio Platform and voluntarily providing us with Information (including Personal Data), you are consenting to our use of the Information, in accordance with this Privacy Policy. If you do not agree with this Privacy Policy, you may refuse or withdraw your consent any time, or alternatively choose to not provide us with any Personal Information.

VI. COLLECTION OF INDFORMATION  

The Company will collect your Information only when you provide it at the time of signing up or registering at the DYT Studio Platform or through emails and telephonic surveys. 

The Company does not control or take any responsibility for the confidentiality of Information including Personal Data shared by you on any third- party website or web page. Please always review and share Information if you consent to their terms and usage of your personal information by them.

Please note that we do not share any personally identifiable Information with anyone without your explicit consent and always try to maintain the privacy of your Information. However, we may need to disclose your Information when we believe it’s in good faith and necessary to comply with judicial proceedings, court order, legal process or when needed to investigate, act against any illegal, suspected or fraudulent activity.

VII. HOW WE USE THE INFORMATION WE COLLECT 

We use you Information as collected on the DYT Studio Platforms in a variety of ways for providing the Services, including the following:  

  1. to provide Services and information that you request; 
  2. to operate, maintain, enhance and provide all features of the Services and/or DYT Studio Platform, to respond to comments and questions and to provide support to Users;
  3. to understand and analyze the usage trends and preferences of our Users, to improve the Services, and to develop new products, services, features, and functionality; 
  4. to personalize our Services and to provide customized advertisements, content, and information; and 
  5. to send email communications, including updates on Workshops, promotions and events, relating to Services offered by us on the DYT Studio Platform.

 

VIII. WHEN WE DISCLOSE INFORMATION:

We may disclose any Information including Personal Data (if required) collected from you to third party only when permitted by you or where it is necessary for compliance of a legal obligation. Your consent is expressly taken to disclose Information including any Personal Data to third parties in the following circumstances:  

  1. We work with third party service providers to provide DYT Studio Platform, application development, hosting, maintenance, and other services for us. These third parties may have access to or may process your Information as part of providing those services to us. Generally, we limit the Information provided to these service providers to that which is reasonably necessary for them to perform their functions, and we require them to agree to maintain the confidentiality of such Information. 
  2. We may share your Information with our affiliates or subsidiaries subject to the terms of this Privacy Policy.
  3. We may disclose your Information if required to do so by law or in the good-faith that such action is necessary to comply with state or the central laws, in response to a court order, judicial or other government subpoena or warrant, or to otherwise cooperate with law enforcement or other governmental agencies or required under applicable law. 
  4. We also reserve the right to disclose your Information that we believe, in good faith, is appropriate or necessary to (i) take precautions against liability, (ii) protect ourselves or others from fraudulent, abusive, or unlawful uses or activity, (iii) investigate and defend ourselves against any third-party claims or allegations, (iv) protect the security or integrity of the DYT Studio Platform and any facilities or equipment used to make the Services available, or (v) protect our property or other legal rights (including, but not limited to, enforcement of our agreements), or the rights, property, or safety of others.
  5. Information about you may be disclosed and otherwise transferred to an acquirer, successor, or assignee as part of any merger, acquisition, debt financing, sale of assets, or similar transaction, or in the event of an insolvency, bankruptcy, or receivership in which Information is transferred to one or more third parties as one of our business assets and provided that such acquirer, successor or assignee shall also put in place reasonable security standards in accordance with applicable Indian laws.
  6. We may make certain aggregated, automatically collected, or otherwise Non-Personal Information available to third parties for various purposes, including (i) compliance with various reporting obligations; (ii) for business or marketing purposes; or (iii) to assist such parties in understanding our users’ interests, habits, and usage patterns for certain programs, content, services, advertisements, promotions, and/or functionality available through the DYT Studio Platform and our Services.

 

IX. YOUR RIGHTS

You have certain legal rights to obtain Information about whether we hold any Information about you, to access your Information we hold about you, and to obtain its correction, update, amendment or deletion in appropriate circumstances. We intend to collect Information only for the purposes for which it is to be used and strive to take reasonable steps to ensure that the Information we collect is reliable for its intended use, accurate, complete, and current. 

Some of these rights may be subject to some exceptions or limitations. Your principal rights are as follows:

IX .1.  RIGHT TO ACCESS, RECTIFY OR DELETE YOUR INFORMATION:

You have the right to request us to access, rectify or delete your Information stored with us. You can ask us to verify whether we are processing your Information. You can ask us to rectify our records if you believe they contain incorrect or incomplete Information about you. Lastly, you can ask us to delete your Information if you withdraw your consent or when we no longer need it for the purpose it was originally collected for. In case any Information is shared after your explicit consent, you may also request to rectify or erase that Information.

IX.2. RIGHT TO RESTRICT PROCESSING:

You have the right to restrict processing of your Information in circumstances where:

  1. you contest the accuracy of you Information;
  2. prefer to restrict its use rather than having us erase it;
  3. where you believe we no longer need your Information for the purpose of processing, but you require Information for establishment, exercise or defense of legal claims;
  4. you have objected to processing, pending the verification of that objection.

IX.3. RIGHT TO OBJECT TO PROCESSING

You have the right to object to processing of your Information on grounds pertaining to your particular situation, but only to the extent that the processing is necessary for:

  1. the performance of a task carried out in the public interest or in the exercise of any official authority vested in us; or
  2. the purposes of the legitimate interests pursued by us or by a third party. If you make such an objection, we will cease to process you Information unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or if the processing is for the establishment, exercise or defense of legal claims.

IX.4. RIGHT TO DATA PORTABILITY:

Where you have provided Information to us, you can ask us to transmit that Information (in a structured, commonly used, and machine-readable format) directly to another company if is technically feasible.

IX.5. RIGHT TO ERASURE:

You have the right to erase/delete your Information without undue delay in circumstances where:

  1. your Information is no longer necessary in relation to the purpose for which is collected or processed;
  2. you withdraw consent on which processing is based;
  3. Information has to be erased for compliance with a legal obligation.

Please note that there are certain exclusions of the right to erasure. Such exclusions include where processing is necessary:

  1. for exercising the right of freedom of expression and information;
  2. for compliance with a legal obligation; or
  3. for the establishment, exercise or defense of legal claims.

IX.6. RIGHT TO WITHDRAW CONSENT

Your participation is always voluntary, and you can withdraw your consent at any time. Withdrawal will not affect the lawfulness of any processing carried out before you withdraw your consent.

You can withdraw your consent/terminate by deactivating your account with us subsequent to which your Information will no longer be collected or processed by us. The Company will retain your Information of a terminated member for an indefinite period of time, until specifically asked by you to delete the same. Even after deactivating your account, the Company will continue to protect such Information in accordance with this Privacy Policy.

IX.7. RIGHT TO COMPLAINT TO A SUPERVISING AUTHORITY

If you consider that our processing of your Information infringes data protection laws, you have a legal right to lodge a complaint with a responsible authority responsible for data protection. X.  RETAINING AND DELETING YOUR INFORMATION:

We do not delete your Information on our own discretion. You are responsible for and control the time periods for which you wish to retain this Information. There are controls in your account where you can delete all of the Information in your account.

You can delete your Information by sending your request at legal@dyt.onl. Your Information shall not be retained with us after such a request has been made by you. However, we may retain some of your Information for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person.

XI.  DATA ENCRYPTION

All the Information transmitted and stored in our server is fully encrypted.

XIII. COOKIES

A cookie is a small amount of data that is sent to your browser from a web server and stored on your computer’s hard drive. The Company uses cookies to enhance performance and user experience on the DYT Studio Platform. It may be used to track the patterns of behavior of Users to the DYT Studio Platform, for quality control and verification purposes.

DYT Studio Platform uses these “cookies” to collect Information and to improve our Service. You have the option to either accept or refuse these cookies, and know when a cookie is being sent to your computer. However, if you choose to refuse our cookies, you may not be able to use some portions of our Service and/or DYT Studio Platform. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies whenever you log in to DYT Studio Platform.

XIV. CHILDREN’S PRIVACY

If you are under the age of 18 (eighteen) years, you must not use DYT Studio Platform or submit your Information unless you have the consent of or are supervised by a parent guardian. In the case we discover that a child under 18 (eighteen) years of age has provided us with any of its information, we will immediately delete such information from our servers. If you are a parent or guardian and you are aware that your child has provided us with its Information, please contact us at  legal@dyt.onl so that we will be able to do the necessary actions.

XV. CONFIDENTIALITY

You must maintain confidentiality, and not disclose to any other person, any information and content that you access or learn in connection with your participation or use of DYT Studio Platform. You are prohibited from sharing with any third party, photographic or other imagery, information, or any other content from any and all activities within or from DYT Studio Platform. You must not use any such information or content for any purpose other than your participation in the Service in accordance with this Privacy Policy. You hereby agree to notify the Company immediately if you learn of or suspect any use or disclosure of, or access to, any such information or content other than as specifically authorized in this Privacy Policy.

XVI. TERMINATION OF USE

The Company reserves the right to cancel or invalidate your account(s), registrations, points and rewards, deny redemption of your rewards, or restrict, block, limit, and prevent your access to and use of DYT Studio Platforms for violation of any Terms and Condition or any policy of the Company or requirements of applicable law.

XVII. LIABILITY

The content created by the Host is exclusively based on Host’s ideas, perception and judgment, and the commercial arrangement between the Host and the Company is strictly limited to give a platform to the Host to create content at the DYT Studio Platform. The said commercial arrangement between the Host and the Company shall not be understood as a remittance for the promotion or their association with any of our clients and/or for publishing the content on any of your social media handles.

XVIII. UPDATE TO THIS PRIVACY POLICY 

By agreeing to use the DYT Studio Platform, you accept this Privacy Policy. The Company reserves the right to make changes to this Privacy Policy. We encourage you to periodically review the Privacy Policy. Your continued participation at DYT Studio Platform after any revisions to this Privacy Policy shall be considered as your acceptance of the Privacy Policy as amended, modified or updated.

XIX. JURISDICTION

If you choose to visit the DYT Studio Platform, your visit and any dispute over privacy is subject to this Privacy Policy and the Terms and Conditions. In addition to the foregoing, any disputes arising out of this Privacy Policy shall be governed by the laws of India and you hereby agree that any such dispute shall be submitted to the exclusive jurisdiction of the competent courts of New Delhi, India.
